Bankruptcy Protection

A number of laws have been formulated to protect the interests of people who file for bankruptcy. Under these laws the individuals have the full right to switch over to alternatives to the traditional Bankruptcy proceedings. A person who finds himself unable to pay back his loan amount can consider filing for bankruptcy in The Bankruptcy Court, a specialized branch of the United States District Court. The protection may involve canceling the debts of the individual or giving him a plan that makes payment easier for him. This is the same in the case of businesses where they are given full or partial relief from debts so that they can continue their work or sell off and pay back the amount to the lenders.

Chapter 7 bankruptcy protection
There are two Chapters under which a person can file Bankruptcy. One is Bankruptcy Chapter 13 and other is Bankruptcy Chapter 7. Chapter 7 is often referred to as “straight Bankruptcy”, referring to a liquidation of debts and non-exempt assets. Under this Chapter the person's assets are handed over to a trustee and he sells them off to divide the amount to the lenders. The person is only allowed to keep some of his property; assets which are classified as exempt and essential to the new beginning that will follow the discharge of debts through Bankruptcy.

Bankruptcy Chapter 13 can be a much better solution for those with the means to comply with its provisions, as it allows for proposing a plan that distributes the payments in an easy and payable manner. No or little interest is charged during this period of the repayment. The individual or the organization is thus protected from his creditors and the creditors will have to agree to the terms by which he will make payments to them.
